Participate as an integral member of owner’s claims evaluation team, being directly responsible for analysis of merit and impact of contractor claims. Work collaboratively with claims evaluation team including estimator, forensic scheduler, and other members of owner’s project team to support evaluation of claimed damages. Integrate information from estimator, scheduler, and project team in a clear and comprehensive report of evaluations. Provide owner with objective assessment of whether contractor has submitted and proven merit of its claim in accordance with requirements of contract; and of claimed schedule delays and costs. Present summary and detailed findings to owner, and to third parties during dispute resolution proceedings, as needed. Engage in direct discussions with contractor, as needed, to understand basis of claims, to support owner’s understanding of potential liabilities, and in negotiation of appropriate settlements.
Job Duties and Responsibilities
Essential Job Duties
Complete analyses of claims within context of contract documents and good industry practice; Integrate multi-disciplinary inputs from field engineering team, legal, financial, cost estimator and scheduler to provide comprehensive and objective assessment of merit and impact to price and schedule
Identify, understand and apply the relevant sections of the contract to each claim
Coordinate with relevant project team experts and resources to obtain information necessary to evaluate claim; critically assess information from claims team and ask clarifying questions as appropriate to understand and evaluate commercial and technical issues
Evaluate and advise owner whether contractor has proven occurrence of a relief event and/or its entitlement to the claimed relief in accordance with the contract documents
Complete independent analysis to determine whether any or part of the claim has merit and provide rationale based on terms of contracts and established facts
Compile cost and schedule impact analyses to determine whether any or part claimed relief is supported by terms of contract and established facts
Objectively identify strengths and weaknesses of independent analysis
Provide reports of analyses and briefing materials as required, compiling work of multi-disciplinary claims evaluation team
Develop reports that effectively communicate complex contractual, price and schedule issues
As applicable to particular claims, provide observations on potential mitigation, related price or schedule issues, communicate to team and recommend recovery alternatives, if any
Develop the record of negotiation and settlement documentation
Contribute to the advancement of LAWA’s goals through commitment to productive collaboration with all stakeholders
Key Identifiers for the Position
Direct experience conducting detailed claims analysis for large, heavy civil construction projects (project value of at least $500M and at least 3-years duration each)
At least 10 years of claims analysis experience with at least 5 years in direct support of a heavy civil construction project
Direct experience with construction project administration and with design-build and/or public-private partnership project delivery
Degree in engineering, construction management, accounting, law or related fields, or a four-year degree with paralegal experience, is preferred
Experience using AutoCAD to efficiently review complex engineering documents, integrate and overlay field engineering updates, and identify whether there are conflicts between contract documents and field conditions, and between proposed and existing infrastructure is required
Qualifications and Experience
Competence with Microsoft Office Suite is required
Competence with Adobe Acrobat is required
Competence with AutoCAD is required
Professional Experience Level/Other Qualifications
Demonstrated experience completing claims analysis in support of the design and construction of large-scale, complex heavy civil projects
Ability to effectively communicate technical and schedule related information in oral and written form to non-expert audiences
Ability to work collaboratively with other subject matter experts and resources to support owner’s evaluation of claims
15 or more years of experience with at least 10 years of claims analysis experience including 5 years in direct support of a heavy civil construction project
Direct experience to support claims analysis for large, heavy civil construction projects (project value of at least $500M and at least 3-years duration each)
Direct experience with design-build and/or public-private partnership project delivery is highly desirable
Demonstrated ability to understand technical and complicated construction program and contract and the ability to communicate progress and findings to both technical and management-level personnel
Prior experience with large transportation projects, particularly transit projects, is highly desirable
Proven accuracy, reliability and completeness in job accomplishment
Degree in engineering, construction management, accounting, law or related fields, or a four-year degree with paralegal experience or directly relevant claims analysis experience, is preferred
May assume other duties as required/needed
